Vacation Rental Policies

RESPONSIBILITY OF RENTER:

The person in whose name the reservation is made must be 30 years of age or older, is required to stay at the vacation rental for the duration of the rental period, and accepts full responsibility for the actions of all persons on the premises during the stay. Failure to honor this requirement will result in eviction without a refund. Any overnight guests in addition to those registered and in excess of the vacation rental’s capacity will result in eviction without refund. Renter agrees to be financially responsible for any damages/repairs to this vacation rental and /or its contents caused by the Renter or Renter’s guest/guests’ negligence or willful conduct during the rental period. Renter understands that there are special risks that may be involved in using special features, i.e. spa, hot tub, Jacuzzi, whirlpool, pool, gas grills, etc., as well as using other areas of the vacation rental. Renter agrees to explain the risks of using the special feature to any guests they may have at the property and will be fully and solely responsible for any accidents. Children sleeping on the floor are a hazard to other occupants in the event an emergency exit is required. A starter supply of paper towels, trash bags, hand soap, dish soap and toilet paper will be provided. Guests are responsible for all other supplies.

RENTAL INFORMATION FORM AND CONDOMINIUM ASSOCIATION FORM:

A Renter Information Form and Condominium Agreement Form (if applicable) will be sent to the Renter upon booking. These form(s) must be completed and returned to Jaqua within 7 days of booking in order for the reservation to be confirmed. If the forms are not returned within 7 days, the vacation rental will be released for booking by another vacation rental.

GOOD NEIGHBOR GUIDE:

It is the responsibility of the renter to become familiar with the Good Neighbor Guide for Renters located in the Jaqua binder at the vacation rental. This outlines South Haven city ordinances.

OCCUPANCY:

Vacation rentals may only be used by the number of adults and children specified on the Renter Information Form. Daily visitors are allowed at the vacation rental, but under no circumstance shall the total number of occupants and guests exceed the maximum occupancy listed for the vacation rental. Occupancy and use of the premises and common areas shall not be such as to disturb or offend guests, residents, or neighbors. In the event this occupancy limit is violated, Jaqua has the prerogative to terminate this agreement and ask disruptive guests to vacate the premises.

WEDDINGS/EVENTS:

No weddings, events, or parties of any kind are to be held at the vacation rental or open areas without the approval of Jaqua. An event is any gathering of people that exceeds the maximum total occupancy for the vacation rental. Failure to honor this requirement will result in eviction without a refund.

PAYMENTS:

Jaqua Realtors Vacation Places & Rentals, LLC, accepts payments by Visa, MasterCard, AMEX, and Discover. For reservations made prior to May 30th, a deposit of 50% of the total reservation is required at the time of booking. The final 50% payment is due 30 days prior to the arrival date or June 1st.  All final payments will be processed automatically to the card on file. For reservations made after May 30th, full payment is required at the time of booking to confirm the reservation.

SECURITY DEPOSIT AND DAMAGE:

Renter agrees to provide a security deposit in the form of a Visa, MasterCard Discover, and AMEX credit card. The renter is responsible to update any credit card information prior to arrival. By signing the attached Renter Information Form, Renter authorizes Jaqua to charge the Renter’s credit card for the cost of any repairs, replacement, breakage, excessive cleaning charges, unreturned keys, unauthorized events, phone charges, or other damages incurred during the Renter’s stay. In the event of a charge, the Renter will be provided with documentation of damages and charges. Each vacation rental is inspected upon departure for damages. Please be sure to return furnishings and home accessories to their original location, strip all beds of linens, place linens and towels in one location, load and run the dishwasher, clean the grill, dispose of all trash in the provided container and remove all food containers from the refrigerator and discard or take with you (additional cleaning fees of $25 per hour will be charged to the credit card on file for any property that is excessively dirty upon check-out).

CANCELLATIONS/CHANGES:

Cancellations will result in full forfeiture of all monies received unless the vacation rental is re-rented. If the vacation rental is
re-rented for the exact time frame and at the same rate, a $250 processing fee will be charged and the balance will be refunded to the Renter. Jaqua Realtors Vacation Places & Rentals, LLC, represents the owners of the vacation rental serving as a Rental agent. Changing your reservation from one vacation rental to another is considered a cancellation and all cancellation policies apply. For requested reservations as a result of the COVID-19 situation, the requests are being handled on a case-by-case basis in conjunction with the vacation rental owner. Any reservations made between April 15 and May 30, will be refundable until June 1, 2021, for dates of stay allowed under the current rental and travel restrictions.   As of June 1, 2021, our previous reservation policy will apply. You may wish to consider purchasing travel insurance through your personal insurance agent to protect yourself in the event of unforeseen circumstances.

CHECK-IN:

Check-in time is 3:00 p.m. EST the day of your arrival at the vacation rental. All our vacation rentals are equipped with an electronic lock or lockbox containing a key. If your vacation rental is equipped with an electronic keypad, please be aware your entry code is time-stamped and will not work until 3:00 p.m. on the day of your arrival. All guests will be contacted approximately 2 days prior to arrival with specific instructions, codes and maps, and check-in details.

CHECK-OUT:

You will receive instructions for check-out procedures prior to your arrival. Renters are required to check-out by 10:00 a.m. in order for us to have the property ready for our next guests. The penalty for late check-out is $100 per hour after 10:00 am, and will be charged to the credit card on file. If your vacation rental has a lockbox, please make sure the key is placed back in the lockbox. If your vacation rental is equipped with an electronic keypad, please be aware your entry code is time-stamped and will no longer work after 10:00 a.m. EST on the day of your departure.

PETS:

The homes that are not pet-friendly have a strict NO PETS policy and violators will be subject to eviction and a $500 damage fee to be charged to the credit card on file.

NO SMOKING:

For safety purposes and in consideration of the vacation rental owners and guests, smoking is prohibited in or around the vacation rental. Failure to honor this request will result in a $500 damage fee to be charged to the credit card on file.

NO FIREWORKS:

Safety is a concern; therefore, no fireworks are permitted on the vacation rental and/or the beach at any time. Failure to honor this requirement will result in eviction without a refund.

HOLD HARMLESS/INDEMNIFICATION:

Prices, vacation rentals, and other specifications are subject to change without notice. In the event a reserved property subsequently becomes unavailable or uninhabitable due to circumstances beyond the control of Jaqua Realtors, a refund may be offered. Jaqua Realtors Vacation Places & Rentals, LLC, the property owner, and any representatives involved with the management of the vacation rental shall be held harmless and indemnified from any claim, loss, expense, damage, or injury resulting from guests’ use or occupancy of the vacation rental. Jaqua Realtors will not assume responsibility for loss, delay, or expense caused by weather or other circumstances beyond the control of Jaqua Realtors Vacation Places & Rentals, LLC.

We acknowledge that COVID-19 represents a serious health threat to persons exposed to it and assume the risks associated with possible exposure to COVID-19 during this rental period. We hereby agree to release, defend, and hold harmless the Jaqua Realtors, the Property Owner, and their respective agents and employees from any and all claims and liability resulting from exposure to COVID-19.

KEYS:

A $50 fee per key will be charged for lost or non-returned keys. If you lock yourself out of the vacation rental and require assistance after normal business hours, the fee will be $50. TRAM/STAIR access keys – A $250 fee will be charged for lost or non-returned keys at applicable vacation rentals.

PARKING:

All vehicles and license plate numbers must be registered with Jaqua Realtors Vacation Places & Rentals, LLC, at check-in. Parking is limited and may not exceed the vacation rental’s maximum allowable vehicles.

TELEPHONE:

Telephones are available in a limited number of vacation rentals and will be indicated as such on the vacation rental contract. All long-distance calls are to be billed to a credit card or the individual’s own home phone. Local, toll-free, credit cards, calling cards, and outgoing collect calls are free.

REPAIRS:

Emergency contact information will be provided in all the vacation rental units. It is imperative the Jaqua Realtors staff be contacted in all emergency situations. Every effort will be made to keep appliances, etc. in good repair. Air conditioners, televisions, and appliances cannot be guaranteed and no refund or rate adjustment will be made for mechanical failure unless the refund is authorized by the owner. If maintenance is necessary, the problem will be addressed as soon as possible after notification by guests.

HOUSEKEEPING:

All the vacation rentals are cleaned prior to arrival. Please maintain the vacation rental in a clean and sanitary condition at all times. It is the responsibility of the renter to provide beach towels. Most of the vacation rentals have on-site laundry facilities for use.

RIGHT OF ENTRY:

Jaqua Realtors Vacation Places & Rentals, LLC, or authorized agents may need to enter the vacation rental for the purpose of inspection, maintenance, or real estate showings. Every effort will be made to prevent any inconvenience or disruption of your vacation.

CONDOMINIUM ASSOCIATION RULES AND REGULATIONS:

Each Condominium Association has specific Rules, Regulations, and Procedures associated with the use of a rental unit within the property. By signing this Rental Agreement, the Renter acknowledges the following:

  1. Renter agrees that no more than the allowable number of persons for the specific unit being rented will occupy the condominium, with single families only. Renter agrees to limit the number of daily guests to that specified by the Condominium Association.

   2. Renter, as well as all other occupants or guests, shall comply with all of the Rules and Regulations of the Association, as well as Rules and Regulations in the Condominium Master Deed documents (if applicable).
